Shares formerly held in L&M Energy Limited
As you may be aware, as a result of the recent takeover offer by New Dawn Energy Limited (‘New Dawn Energy’) for all of the equity securities in L&M Energy Limited (‘L&M Energy’), New Dawn Energy received acceptances resulting in it holding or controlling 90% or more of the voting rights in L&M Energy.
Having reached the 90% threshold, New Dawn Energy became entitled to, and has proceeded to, acquire all of the remaining L&M Energy equity securities under the compulsory acquisition provisions of the New Zealand Takeovers Code.
New Dawn Energy completed this compulsory acquisition process and paid to L&M Energy the proceeds relating to any shares that were outstanding at the time of compulsory acquisition. These proceeds are currently being held in an interest bearing trust account by L&M Energy Limited.
If you have not yet claimed the proceeds related to your former shareholding in L&M Energy, please complete a Claim Form and return it in accordance with the instructions shown on the Claim Form. A Claim Form can be downloaded below.
Please note that the consideration can only be paid to the person(s) or entity recorded as being the previous shareholder in L&M Energy.
Once the Claim Form is returned, the proceeds will be paid to you at the address specified at the top of the Claim Form or to a bank account as nominated by you on the form. Please note that in some instance there may be bank fees associated with this.
We strongly encourage you to complete and return the Claim Form and claim your proceeds as soon as possible. After 6 years, L&M Energy is required to remit any unclaimed funds to the New Zealand Government.
